PERSONAL INFORMATION PROTECTION POLICY OF MCM
(Considering that the relevant national laws and regulations are being continuously promulgated and amended, the Rules will be updated from time to time. Your continuous kind attention will be much appreciated.)

We, MCM China Inc. (Place of incorporation: [Room 3801-3804A and Room 3812, No. 1168 West Nanjing Road, Jing'an District, Shanghai], hereinafter referred to as ‘we’, ‘our’ or ‘MCM’) respect and protect your personal information. We will process your personal information through this Personal Information Processing Rules (hereinafter referred to as ‘the Rules’) in accordance with the Personal Information Protection Law of the People's Republic of China and other applicable laws and regulations. The Rules is applicable to the clients/consumers/business partners situated in the People's Republic of China (excluding Hong Kong, Macau and Taiwan). The Rules is closely related to your use of our service. We recommend that you carefully read and understand the full content of the Rules so that you may make the choices as you deem appropriate. We have tried to use plain and concise languages and to mark clauses that could materially affect your rights and interests in bold, to bring them to your attention. We encourage you to carefully read the Rules so that you could better understand our service and make the reasonable choice.
You understand and agree that, by affirmatively clicking on the ‘I agree’ button and completing the registration during the account registration process, or accessing our websites, social media platforms, WeChat mini programs, or voluntarily providing your personal information to our offline direct-sale stores, customer service centers after affirmatively selecting ‘I agree’, you are acknowledging that you have carefully read, fully understand and agree with the Rules. If you do not agree with the Rules, please refrain from using the above-mentioned services or otherwise refuse to register/provide or log in your personal information.
In addition to the Rules, we will also explain to you why, to what extent and how your personal information is collected by pop-up windows, page prompts or other instant means. The content of such instant notification constitutes a part of the Rules and has the same legal effect as the Rules. So please keep an eye on it.

I. How we collect and use your personal information by MCM
(i) Methods and Channels to collect your personal information
We mainly use the following methods and channels to collect your personal information that are necessary to provide the corresponding service or optimize the quality of products and service after explaining to you the scope and purpose to collect such information and obtaining your consent.
• Emails and texts in the Website and other electronic messages between you and the Website;cn.mcmworldwide.com (hereinafter referred to as the ‘MCM Official Website’)

• Social media platforms (including but not limited to MCM's WeChat official account, WeChat mini programs, Weibo official account, Xiaohongshu account, Douyin account etc.);
• MCM Tmall official flagship store, MCM Tmall official outlet store, MCM JD official flagship store, MCM Douyin official flagship store, MCM WeChat mini program official flagship store or interfaces of other e-commerce platforms which are in cooperation with MCM;
• Entry by filling in customer information cards or using related electronic devices (including but not limited to IPAD) in officially operated offline stores;
• Personal information that you provide by participating in relevant marketing activities, becoming a member, purchasing goods, subscribing for newsletters, completing online survey forms, participating in competitions, promotions or otherwise actively provide through websites, various social media and related programs or interfaces, various e-commerce platforms and related programs;
• Personal information actively provided or filled in in other online and offline channels directly operated and managed by MCM;
• Other relevant personal information obtained from other third parties legitimately.
(ii) Type and purpose of information we collect and use
During your use of our services through the aforementioned channels, we may collect and process the following information relating to you:
1. MCM Official Website
1) To create an ordinary account
When you use the MCM Official Website for purchasing, we will collect your name, mobile phone number, email address, birthday and account number, to verify your identity and create a website account for you.
If you log in with a third-party social media account, we will collect information about your third-party social media account (including account number, nick name and profile picture).
2) To register as an MCM member
When you hope to register as an MCM member, we will, based on your personal information collected to create an ordinary account for you, additionally collect your name, gender, birthday, province, city, complete address and email address, in order to create an MCM member account for you and give you member benefits such as coupons, discount opportunities and birthday gifts. In addition, you may choose to provide us with your occupation, mail address and favorite product type, so that we can provide you with more personalized membership services.
3) To present products and services When you visit or browse our web pages, we may collect your device information (such as the type, operating system and application version and language settings of the device) and log information (including your IP address, website visit history, traffic data, location data, web logs and other communication data), in order to present products and services to you, quickly feed back the search results, determine the security status of your account and/or provide secure transaction services.
Please note that separate device information or log information is not sufficient to identify a specific natural individual. If we combine such non-personal information with other information to identify a specific natural individual or use such non-personal information in conjunction with personal information, such non-personal information will be deemed as personal information during the combined use and we will de-identify such information except where we obtain your authorization or it is otherwise stipulated by the applicable laws and regulations.
4) To purchase products
When you place an order on the MCM Official Website, we will collect your specific order number, order creation time, transaction amount and other relevant information, in order to show you information about your order and facilitate your management of the transaction under your order. When placing an order, you are also required to provide the recipient's name, delivery address, contact number and other relevant information, so that we can deliver the products to you.
To help you complete the payment for an order and deliver products or services to you, we will collect your payment and logistics information related to the transaction progress through the payment institution and logistics company you choose for your transaction or share such information with the aforesaid service providers. Please note that transaction and consumption records are sensitive personal information and our collection of such information is necessary to realize the consumption function. Otherwise, your transaction cannot be completed.
5) To find nearby stores
When you use the store search function on the MCM Official Website, we will collect your city/province, post code (optional), or your current location information (you need to enable the location permission to us on your device), to help you search nearby MCM stores.
6) To subscribe to messages
When you intend to subscribe to MCM brand-related content, we will collect your email address in order to push messages to you.
7) To consult and leave messages
When you use the online chat function, to provide you with online customer services, we will collect your chat content with us (the text and pictures you upload) and when necessary, we will require that you provide the relevant personal information to match and verify your user identity to guarantee the security of your account and system. If you refuse to provide the relevant personal information or you provide the wrong personal information, we may not be able to provide you with the required support.
When you use the offline message function, we will collect your name, email address, mobile phone number (optional), and the content of the message (the text and pictures you upload), in order to respond to you by email or phone.
2. MCM Member Center WeChat mini program and WeChat official account
1) To follow the MCM WeChat official account
When you intend to follow the MCM WeChat official account, we will collect your WeChat OpenID and WeChat UnionID, in order to push the official account's articles or related notices to you.
2) To register as an MCM member
When you intend to register as an MCM member through MCM Member Center WeChat mini program, we will collect your name, gender, birthday, province, city, complete address and mobile phone number, in order to create an MCM member account for you and give you member benefits such as coupons, discount opportunities and birthday gifts. In addition, you may choose to provide us with your occupation, mail address and favorite product type, so that we can provide you with more personalized membership services.
3) To find nearby stores
When you use the store search function on the MCM Member Center WeChat mini program, we will collect your city/province, post code (optional) or your current location information (you need to enable the location permission to us on your device), to help you search nearby MCM stores.
4) To consult and leave messages
When you use the function of sending messages on the WeChat official account, to interact with you or answer your questions, we will collect your WeChat chat content with us (the text and pictures you upload) and when necessary, we will require that you provide the relevant personal information to match and verify your user identity to guarantee the security of your account and system. If you refuse to provide the relevant personal information or you provide the wrong personal information, we may not be able to provide you with the required support.
5) To participate in interactive games, event reservations and questionnaires
When you participate in an interactive game we set on the WeChat platform, to obtain basic device permissions and provide you with the game content, we will request access to the camera permission and other permissions of your device.
When you participate in an event reservation and questionnaire we publish on the WeChat platform, we will collect your mobile phone number and the text and picture you upload, in order to confirm the event participant, push event reminders, and record the questionnaire content.
3. Official accounts of MCM on other social media platforms
1) To follow official accounts
When you intend to follow MCM's official accounts on other social media platforms, we will collect your account information (ID, nick name and profile picture) on these social media platforms, in order to display the relevant content or give notice to you.
2) To leave comments or messages
When you use the comment or message function of other social media platforms, we will collect the text and pictures you upload, in order to display your comments or messages or interact with you.
3) To participate in event reservations and questionnaires
When you participate in an event reservation and questionnaire we publish on other social media platforms, we will collect your mobile phone number and the text and picture you upload, in order to confirm the event participant, push activity reminders and record the questionnaire content.
4. MCM stores on third-party e-commerce platforms
(Including but not limited to MCM Tmall official flagship store, MCM Tmall official outlet store, MCM JD official flagship store, MCM Douyin official flagship store, MCM WeChat mini program official flagship store)
1) To register as an MCM member
When you intend to register as an MCM member, we will collect your name, gender, birthday, province, city and complete address, email address, mobile phone number and platform ID in order to create an MCM member account for you and give you member benefits such as coupons, discount opportunities and birthday gifts. In addition, you may choose to provide us with your occupation, mail address and favorite product type, so that we can provide you with more personalized membership services.
2) To present products and services
When you visit or browse the MCM store pages on third-party platforms, we will collect your device information (such as the type, operating system and application version and language settings of the device) and log information (including your IP address, website visit history, traffic data, location data, web logs and other communication data), in order to present products and services to you, quickly feed back the search results, determine the security status of your account and/or provide secure transaction services.
Please note that separate device information or log information is not sufficient to identify a specific natural individual. 4) To contact the customer service
When you use the function of contacting customer service, we will collect your chat content with us (the text and pictures you upload), in order to provide you with online customer services.
5. MCM stores and other offline channels
1) To register as an MCM member
When you intend to register as an MCM member, we will collect your name, gender, birthday, mobile phone number, email address, address and post code by inviting you to register with the MCM Member Center WeChat mini program, or filling in a Customer Card or filling in your relevant information in the member registration system on mobile device based on actual situations, in order to create an MCM member account for you and give you member benefits, such as coupons, discount opportunities and birthday gifts. In addition, you may choose to provide us with your occupation, mail address and favorite product color and type, so that we can provide you with more personalized membership services.
2) To purchase products
When you place an order at an MCM store, to process your order, we will record the specific order number, purchase date, product information and amount of consumption through our order management system.
To help you complete the payment, we will collect your payment information related to the transaction progress through the payment institution you choose or share such information with the aforesaid service provider. Please note that transaction and consumption records are sensitive personal information and our collection of such information is necessary to realize the consumption function. Otherwise, your transaction cannot be completed.
3) To participate in offline promotion and experience activities
When you participate in an offline promotion or experience activity organized by us, we may collect your name, gender, birthday, address, mobile phone number, third-party social media platform account and other relevant information, in which case, we will separately explain it to you and obtain your authorization or consent. If you do not provide the above information, you will not be able to participate in the promotion/experience activity or obtain the corresponding prize/gift.
The information we collect is necessary to achieve the functionality you want. We store information in an encrypted manner, and you can delete it at any time. Unless authorized by you at your sole discretion or as required by relevant laws and regulations, we will not provide the above information to others or use it for other purposes than this function.
(iii) Exceptions with your authorization and consent
In accordance with relevant laws and regulations and national standards, we may collect and use your personal information in accordance with the law in the following circumstances without your consent:
1) Directly related to national security or national defense
2) Directly related to public safety, public health or vital public interests
3) Directly related to criminal investigation, prosecution, trial and execution of judgment
4) For the purpose of safeguarding the life, property and other major legitimate rights and interests of you or others, in which case your consent is difficult to obtain
5) The personal information collected is disclosed to the public by yourself
6) The personal information is collected from legally publicly disclosed information, such as legal news reports, government information disclosure, etc.
7) Necessary to sign and perform the contract according to your requirements;
8) Necessary to maintain the safe and stable operation of the services provided, for example, to discover and handle the malfunction for certain products or services
9) Other circumstances as stipulated by laws and regulations
II. How we share and protect your personal information
1. Place we store your information and cross-border data transmission. If due to business needs or it is necessary for providing you with better service, you understand and agree that, we may transfer relevant personal information collected in China to the MCM Group's overseas affiliated institutions or partners located in Korea, Europe, Singapore, Japan and United States. We will implement the regulations in accordance with laws, administrative regulations and relevant regulatory authorities. We will require these foreign institutions to keep confidential your personal information by signing agreements, monitoring, and other effective measures. In addition, we will conduct security assessments in accordance with laws, regulations and national standards and meet their requirements.
2. Our data security capabilities and protection measures. We undertake to maintain information security to the level as specified by the laws and regulations. In order to keep your information safe, we commit to applying various safety technologies and associated management systems to protect your information from leakage, corruption, or loss. We will implement the necessary management mechanisms and technical measures in accordance with applicable laws, regulations and relevant requirements of national standards. However, we cannot anticipate and guard against all legal, technical, and other risks at any time, including but not limited to service interruptions, data loss, and other losses due to viruses, Trojans, hacking, system instability, third-party service defects, government actions, etc., therefore, you understand and agree that to the extent permitted by law, we do not assume any legal liability for any incidental, special, or indirect damages or claims arising out of the foregoing unforeseen circumstances.
3. The security of your account and password. Please be sure to keep your account and password safe. When you access or use our services, we will identify you by your account number and other identity elements. Once you disclose the above information, you may suffer losses and may have legal consequences that are unfavorable to you. If you find that your account or password has been illegally used or has been used abnormally, you agree to contact MCM directly at contact.cn@mcmworldwide.com to let us know so that we can take action to avoid or reduce the loss.
4. Period of information storage and deletion. We will only store your personal information during the period which is necessary for the purpose of the Rules or required by the laws and regulations, or until you withdraw your consent to our processing of personal information or request deletion, or until the purpose of our processing has been achieved.
III. How we share your personal information
(i) Data sharing and transferring
In principle, we will not share or transfer your personal information to any companies, organizations or individuals. In the following exceptional circumstances, we will share your personal information for legal, legitimate and necessary purposes. Third parties receiving such data have no right to use personal information for any other usage that you are not notified of by the Rules. In Particular, you understand and agree that MCM will share your personal information with its affiliates, third-party service providers or partners under the following circumstances.
1. Necessary for providing products and services to you
• Payment institution: when you purchase products through the MCM Official Website or a third-party e-commerce platform which is in partnership with MCM, we may share your transaction information (order number and order amount) with the relevant bank and third-party payment institution, to complete the payment.
• Delivery service company: to deliver the products you purchase, we must share the recipient's name, delivery address and mobile phone number you provide with the delivery service company.
2. Share information with affiliates, third-party service providers, or partners • Third-party e-commerce platform or franchisee: to provide you with more consumption and purchase channels, we may share your purchase-related information with third-party e-commerce platforms or franchisees in partnership with us. • Third-party social media platform: we may share your contact information, etc. with third-party social media platforms in partnership with us so that they can communicate with you.
3. Transfer information when MCM has undergone acquisition, merger or reorganization
With the continuous development of our business, MCM may engage in transactions including mergers, acquisitions and assets transfers. We will notify you of relevant facts and continuously protect or cause data recipients to continuously protect your personal information pursuant to the laws and regulations, with the standard not lower than that under the Rules.
4. Share information within MCM Group
MCM may share and receive personal information within the MCM's affiliated group of companies, so that MCM may inform you of other products that may be of interest to you, improve your shopping experience, and improve our website design. In particular, for the purposes mentioned above, we may also share your personal information with MCM's affiliated group of companies and our franchisees either in China or overseas (including but not limited to Korea, Europe and United States), and use your personal information according to their analysis and decisions. 5. Share your personal information pursuant to the laws and regulations and mandatory requirements imposed by regulatory authorities.
We may provide your personal information to the competent regulatory agencies pursuant to the applicable laws and regulations, the court orders or any other provisions of legal proceedings, or mandatory requirements imposed by administrative or judicial bodies. Information sharing under such circumstances may not require your authorization or consent.
(ii) Processing of personal information by integrated third-party SDKs
For the purposes stated in the Rules, we may integrate SDKs or other similar applications (such as embedded code, plug-ins and H5) provided by third-party service providers to provide you with better customer services and user experience.

IV. How to exercise your personal information-related rights
You can help MCM maintain the accuracy and validity of your personal information. At any time, you have the right to access, copy, transfer, modify, supplement and delete your personal information, and you can perform corresponding operations through [MCM Member Center/MCM Official Website] – ‘My Account’, or through the feedback channels listed in the ‘Contact us’ section of the Rules. Please understand that in order to fully protect your rights, we need to verify your identity before operating your personal information. Once verified, we will handle it for you within 15 working days.
Unless otherwise specified by the laws and regulations, when you modify, supplement or delete your personal information or apply for canceling your account, we may not immediately modify, supplement or delete the relevant information from the backup system, but we will modify, supplement or delete such information when updating our backups. Please note that the relevant information or account will not be recovered once deleted or canceled. So please proceed with the operations carefully.
If an account holder is deceased, his/her close relative may contact us according to the contact information set forth in the ‘Contact us’ section, to legally exercise the statutory rights over the relevant personal information of the deceased.
In principle, we do not charge for your reasonable requests, but we will charge for repeated requests that exceed reasonable limits at our discretion. We may refuse requests for information that is not directly related to your identity, repeated requests without reasonable justification, or requests that require excessive technical means (such as requiring the development of new systems or fundamental changes to current practices), pose risks to the legitimate rights and interest of others, or are impractical.
V. How we apply Cookies and other information recording technologies
1. How we apply Cookies and other technologies to automatically collect information. To give you better service experience, when you visit our Website or use our services, we may identify you by small data files (such as Cookies), which can save you the need to repeatedly enter your registration information, or help determine the security status of your account. Please understand that some of our services can only be implemented by using Cookies. You can modify the acceptance of such Cookies or refuse to accept them as your browser allows. The Help Settings section of most browsers' toolbars tells you how to completely turn off Cookies or refuse to accept new Cookies. 2. How the third-party data companies contracted by us collect information. Our Website also uses Google Analytics, a web analytics service provided by Google, Inc. (‘Google’). 3. Third party Cookies or Beacons that may exist on our products and services. Our products and services may have imported Cookies and Beacon placed by advertisers or other partners. These Cookies and Beacons may collect non-personal information relating to you to analyze your usage of services, send advertisements you may be interested in or assess the effects of advertisements. Cookies and Beacons applied by third parties for collecting and using such information are not under MCM’s control and therefore are not bound by the Rules but only subject to their own personal information protection policies. Therefore, we shall not be liable for Cookies or Beacons used by third parties.
4. How to refuse us to use Cookies and other information logging programs to collect your personal information. You can refuse to use Cookies and other information logging programs by selecting the settings on the browser, but as mentioned above, please note that if you refuse to use information logging programs, you may not be able to use the functions of some parts of the Website.
VI. Statement of liabilities to third parties
Please note that operators of third-party websites you visit, third-party service (including but not limited to social media or other service link provided by third party, such as Baidu Map, Tencent Map, etc.) you access to through us when using products and services provided by us and third parties receiving your personal information from MCM may have their own personal information protection policies. These third parties may collect and use your personal information when you view pages created by such third parties or use applications developed by such third parties. Please note that we are not directly involved in the abovementioned third parties’ data collection and use, their collection and use of data are not bound by the Rules, but by the personal information protection policy of relevant collectors or users, and we are not liable for the foregoing data collection and use by such third parties. We will make commercially reasonable efforts to have these third parties adopt data protection measures on your personal information. However, we cannot guarantee that these subjects will take protective measures as we request. If you find that there are risks in web pages created by or applications developed by these third parties, we recommend that you terminate the relevant operations to protect your legitimate rights and interests.
VII. Special agreements on protection of minors' personal information
1. Our services are not intended for minors under the age of 18. We will not intentionally collect personal information from minors under the age of 18. If you are under the age of 18, please do not provide any information on MCM official website, MCM stores on third-party e-commerce platforms, MCM social media accounts or offline stores, or through any other channels, do not register on MCM official website, MCM stores on third-party e-commerce platforms, or MCM social media, do not purchase any products on MCM official website, or MCM stores on third-party e-commerce platforms, do not use any of the interactive or public comment features of MCM official website, MCM stores on third-party e-commerce platforms, or MCM social media to provide us with any information about you, including your name, address, phone number, email address, any account name or username.
2. If we learn that we have collected or received personal information from a minor under the age of 18 without the consent and verification of his/her guardian, we will delete or anonymize that information. If you reasonably believe that we might have stored any information from or about a minor under the age of 18, please contact us according to the contact information set forth in the ‘Contact us’ section.
VIII. Application of and update to the Rules
1. The Rules applies to the collection, use and processing, etc. of the users/consumers/business partners’ information within the People’s Republic of China (excluding Hong Kong, Macau, Taiwan). The Rules does not apply to any third party (including our branches, affiliates, or franchisees) and online or offline stores that are not directly operated by MCM, and other websites using language other than Chinese to serve overseas users/consumers, including any applications or content (including advertisements) that are linked to or available through the aforesaid websites.
2. We may make changes to the Rules as appropriate. We will post the updated Rules on the Website, and thus we encourage you to review this page from time to time, particularly each time you use the Website. Your continued use of the Website, e-commerce platforms, social media, programs, or your absence of submission of any written objections through our designated official channel after we make updates or changes to the Rules shall be deemed that you have fully read, understood and accepted the updated Rules and are bound by it. You may also find the Personal Information Processing Rules updated from time to time in the social media platforms. We encourage you to review our Personal Information Processing Rules from time to time and give us reasonable comments and suggestions.
IX. Candidate information collection and processing
We will collect your personal information necessarily related to recruitment through the headhunting company and requiring you to fill out relevant forms online and offline. We will confirm with such headhunting company the legitimacy of its sources of information. If you are not hired, your personal information may be retained by us for reasonable time period for the purposes of internal management and re-hiring you. After the employment, relevant provisions shall be subject to the ‘Employee Handbook’. Please refer to the Rules for other relevant information.
The personal information you fill out for employment includes, but is not limited to, the following: name, age, ID number, education, school and study rankings, WeChat account number, contact information such as the mobile phone number and email address, emergency contact (you shall guarantee that you have already obtained the consent of the emergency contact before you provide us with emergency contact information), work experience, photos, etc.
For personnel management purposes (positions, salary approvals, etc.), you understand and agree that we will transfer relevant personal information (e.g. name, department, date of entry, salary information, etc.) collected in mainland China to MCM Group's affiliates or institutions located in Hong Kong. We will proceed in accordance with laws, administrative regulations and requirements of relevant regulatory authorities, and require these foreign institutions to keep confidential your personal information by signing agreements, monitoring, and other effective measures. In addition, we will conduct security assessments in accordance with laws, regulations and national standards and meet their requirements.
